1. Information on how to enter the Promotion forms part of these terms and conditions. Entries not made in accordance with these terms and conditions will be disqualified. Acceptance of the major prize by the major prize Winner is deemed acceptance of these terms and conditions.
2. The Promotion commences at 9.00am on 10/06/2010 and closes at 5.00pm on 31/07/20110 ("Promotion Period"). All times recorded throughout these terms and conditions are in Australian Western Time. The Promoter is Geographe Bay Tourism Association, 38 Peel Terrace, Busselton, Western Australia 6280 (ABN 98 728 033 827) ("Promoter").
3. Entry is only open to persons who complete a Beachcomber Project Survey Form, is aged 18 years or over and complies with the entry criteria in accordance with these terms and conditions. Employees of the Promoter and their immediate families, participating agents and their agencies associated with this Promotion are ineligible to enter. The Promoter reserves the right to verify the validity of each entry. The Promoter reserves the right to disqualify any person for tampering with the entry process.
4. A representative of the Promoter will conduct a random draw of all submitted entries. One (1) major prize winner will be manually selected at random from a computer-generated listing of entries that comply with these terms and conditions over the Promotion Period. There will be a total of one (1) major prize awarded. There will be one (1) draw for the one (1) prize and the first valid entry drawn will be the winner of the major prize listed below in clause 6. The draw will take place at 12.00 pm on 02/08/2010 at 38 Peel Terrace, Busselton, Western Australia 6280. Attempts will be made to notify the Prize Winners by mail or email and telephone by 13/08/2010.
5. Prizes must be taken between 02/08/2010 and 31/12/2010, and are subject to availability at the time of booking. Prizes are not valid during school or public holidays or special events. Any part of the prizes not used by 31/12/2010 will be forfeited.
6. The total prize pool is valued at up to AU $1,590 and consist of: Four (4) nights accommodation in a spa villa at Beachlands Holiday Park valued at $1000; A mixed case of Windows Estate wines valued at $240; A Taste the South Wine Tour for two (2) people valued at $150, a $100 voucher for the Goose Cafe; $50 voucher for Hillzeez Down South Surf Shops.
7. In the case of each prize, spending money, meals, taxes, surcharges, insurance, passports, visa requirements, transport to and from airport for departure/arrival (except where specified), additional transfers and all other ancillary costs are the sole responsibility of the winner.
8. If a Prize Winner wishes to claim their Prize, the Prize Winner must confirm this fact and his/her eligibility to win under these terms and conditions by 12.00noon on 13/08/2010. If the Prize Winner fails to do either or both of these things by the deadline, that Prize Winner will be deemed to have forfeited the prize.
9. In the event that any Prize Winner forfeits the Prize or a Prize remains unclaimed the Promoter will conduct a redraw for the unclaimed Prizes only, following the same procedure as the original draw.
10. The Prize is not transferable to other persons or organisations. The Prize is not redeemable for cash and cannot be taken as cash. If a Prize or receipt of it incurs a tax liability, the relevant Prize Winner is liable for payment of such tax. In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.
11. Subject to the State legislation the Promoter reserves the right to substitute the Prize in whole (or any of its components), with a substitute prize of equal or greater value and the Prize Winner will be notified accordingly.
12. The Prizes cannot be used in conjunction with any other special offer.
13. Neither the Promoter nor any other person or party associated with the Promotion shall be liable for any loss or damage whatsoever suffered (including but not limited to direct, indirect, consequential or economic loss) or personal injury suffered or sustained in connection with either participation in the Promotion or with any Prizes offered, except for any liability that cannot be excluded by law. The Promoter will not be responsible for any delayed, lost or misdirected mail, email or any other communication. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any Website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
